District Court for the District of Columbia ruled that e-cigarettes did not meet the criteria for drug-delivery devices and therefore were exempt from regulation under the FFDCA. The court did rule, however, that the FDA could regulate e-cigarettes as tobacco products under the Family Smoking Prevention and Tobacco Control Act (TCA), since the nicotine contained in some of the e-cigarette cartridges was derived from tobacco. Reports in 2018 of increased e-cigarette use among adolescents and teenagers in the United States prompted the FDA to identify strategies for combating e-cigarette use by minors. Altria’s data showed Njoy e-cigarettes helped smokers reduce their exposure to the harmful chemicals in traditional cigarettes, the FDA said. The agency stressed the products are neither safe nor “FDA approved,” and that people who don’t smoke shouldn’t use them. The FDA regulates the manufacture, distribution, and marketing of tobacco products, such as cigarettes, cigars, and e-cigarettes (sometimes called “vapes”).

Of the 544 young people who owned e-cigarette devices, 75.7% said that they considered recycling e-cigarettes. One chemical, known as 6-methyl nicotine, has been shown in rodent experiments to be far more potent than nicotine in targeting the brain's nicotine receptors and more toxic than nicotine. Another, called nicotinamide, is marketed as targeting the same brain receptors as nicotine, despite evidence it does not bind to these receptors.
In response to this issue, the PACT Act Amendment prohibits sellers from using the U.S. Post Office to ship e-cigarettes, vapes, flavored and smokeless tobacco products. Today's rapidly evolving e-cigarette market includes many varieties of disposable e-cigarettes, or single-use e-cigarettes, that do not use pre-filled pods containing e-liquid. The latest e-cigarettes also contain some of the highest nicotine levels ever seen in tobacco products. While some claim to be “tobacco-free” — made with lab-created synthetic nicotine, or with nicotine that does not come from tobacco — synthetic nicotine products still contain nicotine. E-cigarettes are products that heat a solution that typically includes nicotine and flavoring.
In fact, the overall evidence points to e-cigarettes actually helping people to give up smoking tobacco. There is no evidence that e-cigarettes are undermining England’s falling smoking rates. Instead the evidence consistently finds that e-cigarettes are another tool for stopping smoking and in my view smokers should try vaping and vapers should stop smoking entirely. E-cigarettes not only pose substantial health risks to youth and young adults, they pose a significant environmental threat (see the Truth Initiative fact sheet on Tobacco and the Environment). Almost half (49.1%) of young people don’t know what to do with used e-cigarette pods and disposable devices. A second brand of e-cigarettes—marketed as Nixotine, Nixodine, Nixamide and Nic-Safe—contained a nicotine analog called nicotinamide, also at levels lower than the labels indicated, and combined with undisclosed amounts of 6-methyl nicotine.
Despite this trend all current evidence finds that e-cigarettes carry a fraction of the risk of smoking. The 966 respondents who had never vaped more often believed that e-cigarette waste was dangerous to throw in trash compared to the 1,083 respondents who had vaped at least once (81.4% vs. 71%). Fewer of those who had vaped at least once (79.3%) believed that e-cigarettes contained toxic substances compared to those who had never vaped (89.6%). Young respondents clearly recognized the dangers of e-cigarette waste to humans and the environment and want an appropriate method to recycle.
